New Statement of Rights Coming into Effect 1 November 2025

From 1 November 2025, the Statement of Rights under the new Aged Care Act 2024 will replace the current Charter of Aged Care Rights. This marks a significant step in strengthening the protection of older people’s rights and placing them at the centre of aged care in Australia.

About the Statement of Rights

The Australian Government is introducing a new rights-based Aged Care Act that prioritises the dignity, independence and wellbeing of older people.

The Statement of Rights sets out what people accessing Australian Government–funded aged care services are entitled to. It ensures that older people have greater choice, control and respect when receiving care and support.

What the Statement of Rights Means for You

The new Statement of Rights is designed to make sure you remain at the centre of your aged care. It includes the right to:

  • Make your own decisions about your life and the care you receive.
  • Have your decisions respected, even if they involve personal risk.
  • Receive information and support to help you make informed choices.
  • Feel safe, valued and respected in all aspects of care.
  • Have your privacy protected, including how personal information is shared.
  • Access safe, high-quality care that meets your needs and is delivered by qualified staff.
  • Communicate in your preferred way, including through interpreters or communication aids if needed.
  • Stay connected with family, friends, pets and your community.
  • Receive fair and timely responses to complaints or concerns, without fear of reprisal.

Respecting Independence, Safety and Culture

The Statement of Rights recognises that older people should have independence, autonomy and the freedom to make choices about their lives. It also ensures fair access to services that are culturally safe, trauma-aware and inclusive for all individuals, including those living with dementia.

Older people have the right to care that is free from abuse, neglect and discrimination, delivered in a way that values their culture, spirituality and personal experiences.

For Aboriginal and Torres Strait Islander peoples, the Statement of Rights also upholds the right to remain connected with community, Country and Island Home.
